the first to let you know. unfortunately, the day has come end quote. david louie is live with the story tonight. david? >> well steve jobs has been on a medical leave since the first of the year but neither he nor the company have been willing to say what the medical condition s that has led to speculation. with today's surprise announcement, the company made it clear it was prepared for this day. now jobs has been apple's front man for years. the public face of a company with loyal customers. his key note speeches at conferences inspired them to create applications to run on ipads, and mac computers. he built apple into a best known brand recommending his number-two executive tim cook succeed him. the board agreed. there are now concerns whether he can fill steve jobs' shoes with the same style.

>> tim cook could never do what steve jobs did for apple. i don't see him as the kind of person that can have the focus whurk look at steve jobs he's a different kind of leader. he's not just a business person. he's someone who really thinks about the human experience and tells you what you want to think. >> and cook will now take over a company grown into a global power house, making more than half of the revenue from selling apple products overseas. and apple will make ipads more important than lap top computers, apple's customers realize apple won't be the same without steve jobs at the helm oo. i think it's big. he's apple. soy think it's big. >> it's been done pretty wofrl the last few decades. yeah. we'll see what happens. >> and i just hope they find someone as innovative as he

board of directors today in a hearing over the decision to shut down phone service recently. abc 7's laura anthony joins us with more. laura? >> the board took no action today but there was a clear message that some of them regret this cutting off off of cell service. two directors said that it should only be done again in the most extreme circumstance. >> we're not asking you for permission to protest. we're going to do it anyway. regardless of your policies. >> a protest chastised the bart board for actions that the police force took to curtail their demonstration. including shutting off cell phone service one month after this protest on july 11th. a move bart police chief claims was done in response to actions protesters them self autos what we knelt group is doing is promoting and inciting illegal behavior in

order to disrupt our service. >> we know you don't care about public safety. because if you cared you won't barricade passengers in stations. and then tell them to evacuate. you won't turn off abilities to call 911. >> the board now plans to stish a new policy on when service should be cutoff in the future. >> if we're going to shut off cell phone service ever it needs to be under the most extraordinary circumstances. >> other board members defended the chief's decision during the protests. >> you can't use your cell phone on an airplane. there are reasons why there are some restriction ootz aclu launched a discussion to be focused on what happens in the future. >> do we want to have a society where the government is in a position to shut down a communications network use bid thousands of people? >> the demonstrators say whether bart establishes a policy has little to do with

whether protests will continue. >> protests will end when you disband your police force. shutting down cell phones won't stop protests. >> next protest set for next monday at the height of the evening commute. bart police said they have no plans to shut off cell phone service but they have zero tolerance for protests extending on to platforms. in oakland abc 7 news. >> the attempted robbery of an armored truck ended in a gun battle with police in pinole. one suspect is dead. another is in the hospital. a police officer and security guard were wounded. it began around 9:00 this morning outside of wells fargo in pinole. a security guard got into a shootout with a pair of would be robbers. police arrived and a second shootout broke out and a suspect was killed. >> i heard shots go off. there was a guy running down street with a bag of money. i saw him collapse. he fell and never moved again.

>> police say a second robber got waichl they shut down much of fitzgerald drive. now that man later turned up in a hospital with a gunshot wound. and officer was hurt. >> my understanding is that it was one shot that our officer took to the shoulder he's been transported to the hospital and being treated. >> the security guard is also being treated for a gunshot wound. she was in surgery. >> and new test results from a 10-year-old murder mystery of janine harms link aid prime suspect to the murder. her body has never been found. the district attorney today confirmed that fibers from a rug in her home matched those found in a vehicle owned by maurice nasmay. they believed he killed harms. this is the second round of testing. it took three years to complete. >> we in the district attorney's office along with los gatos police department

did a very thorough and extensive investigation in this case. did we do the investigation as quickly as it could have been done? no. >> back in january harms brother killed nasmay then himself. nasmay maintained his innocence. >> fire crews have begun to remove thousands of gallons of propane in a sacramento suburb. firefighters have been pouring water on the tanker since the blaze broke out yesterday to keep it from boiling up. specialists were flown in to hot tap the rail car that drains liquid propane while the fire rages on. workers spent the day digging a pond where the propane will be off loaded so it can be burned off. the process is expected to take about four hours and it's tricky stuff. thousands have been evacuated for their safety. >> and a san francisco

chinatown merchant standing trial arks accused of passing counterfeit $100 bills print sod perfectly they fooled most banks. vic lee joins with us the story you'll see only on 7. vick? >> this counterfeit bills are almost identical to this $100 bill. it's difficult to tell the difference. now, the secret service says bills confiscated were of the highest quality. they started this investigation four years ago. their target was this merchant in chinatown. summer 2007 price of gold taking off. >> the defendant in this case has a store in chinatown that deal was gold gold coins. he passed occurrencey to a number of victims in and during a number of transactions. >> the 82-year-old peter chang listened in court secret service agents testified in this trial. he was arrested in november

2008. authorities say it was from this family-owned jewelry store that chang handed out counterfeit $100 bills to pay for gold coins. they say he gave $36,000 of the fake occurrencey to three unsuspecting victim autos we believe this defendant did know that the money he was passing was counterfeit. >> his attorney says his client was fooled just like everyone else. the bogus bills look almost identical to real money. the secret service calls these super notes. >> they have all of the security features threads letters holograms. they pass the detection pen and bank machine autos took a sophisticated detection machines in bank of america. to catch the fakes the $100 super notes were perfect. except for one thing. the printing of the "n" in united states was slightly

different. so where do these counterfeit bills come from? >> we've been advised by the secret service agents they have a belief they come maybe from north vietnam maybe from north korea. maybe from russia. >> both prosecution and lawyer as agree that is not an issue in this case. >> it's whether or not my client knowingly possessed theegs as counterfeit. and passed them as counterfeit. >> six years ago the government accused north korea of making super notes and passing them through an extensive international network of asian-organized crime. the secret service agent who testified today said it was rare to see that many super notes $36,000 worth in the possession of just one person. and they want to know where those fakes come from. vic lee abc 7 news. >> thank you very much. >> there is more head here on abc 7 news at 6:00. a small town that has gone

residents were without it for 24 hours. the problem didn't have to happen. wayne freedman joins us live to explain. wayne? >> it was a bit of a delayed reaction. they take water from a well roughly 30,000 gallons per day with a pump. last week, that pump broke. nobody knew about it. that led to all of the problems. tonight the water is flowing and in places boiling again. as to frustration of residents that is simmering too. it's neglect and last week this pump that draws water failed and since the county had long defered maintenance no alarms sounded. by monday, the tank had run dry. schools closed. >> our regulations are strict. >> restaurants remain closed. >> what do you think you're losing in terms of business? >> a lot. >> what is a lot?

ended its controversial deployment of homeland security officers. the department launched operation community shield to battle an increase in gang violence and the highest murder rate in 20 years through june, san jose had 14 gang related killings. since june officers made 300 arrests 70% of them gang related. police plan to continue collaboration was the gang prevention task force. >> law enforcement from 10 counties came today to deal with an impending jail crisis. the district attorney hope hosted a meeting of police chiefs and sheriffs. the goal to have a plan ready by october 1. that is when the state will transfer responsibility for thousands of inmates from state prisons to county jails. >> we have to determine what would be the best course of action to one, ensure our communities are safe because that is the important part but

we did have sunny, mild to warm conditions across the bay area today. high temperatures down in virtually all locations from yesterday, and in normally hot spots like fairfield two three degrees cooler 11 degrees cooler at napa today san francisco down 10 degrees from yesterday's high. and there is half moon bay one degree warmer now looking at temperatures 90 degrees in concord. 86 livermore. 64 san francisco. and 78 in santa rosa. 78 in san jose. highlights fog along the coast and locally around the bay cooler days through friday. then we'll have warmer weather this weekend. water vapor shows a deepening jet stream there. it is helping to deepen our marine layer that. is giving us a cooler pattern than we've had. low temperatures tonight will not be cool however mild with lows mainly into mid to

a 3.6 after shock rattled the bay area today struck just before 10:00 a.m. and both tremors and at least four small ones were centered three miles north of san leandro. there was also a 4.4 earthquake early today near mammoth lakes. and a 7.0 quake in jungles of northern peru. >> crews are still seasing damage from the east coast's biggest quake in decades. it caused a four-inch crack in the washington monument and broke cap stones at national cathedral. damage to the cathedral is in the millions of dollars and hundreds have been displaced from high-rise apartments and residents are realing from the rare quake. >> i thought it was a bomb. so it was alarming. it was. >> everybody thinks this

hurricane irene is picking up speed tonight and could become the strongest hurricane to hit the east dmoft a

decade. it's making its way over the bahamas tonight now a category three storm, packing 120 miles per hour winds. the storm already hit puerto rico knocking down trees flooding homes and causing mudslides. one woman was killed. it's path is taking it towards north carolina's outer banks. officials urging everyone to get ready. >> we want folk there's to take this storm seriously. and to get prepared. >> it's a low-lying island. if it's a bad storm it won't take much of a elevation of sea level to create a lot of havoc over there. >> forecasters say the storm could hit the atlantic seaboard sunday. but officials in north carolina are not wasting time. they will order tourists to leave tomorrow in, virginia the navy is preparing to move ships starting tomorrow as well. >> and for the past four years we've been reporting on a marin county oyster farmer fighting to keep his business alive.

the farm is in the point reyes national sea shore. the lease expires next year some insist it has to go because congress intended it to be wilderness. lawmakers that create that had park are telling a different story. oyster farmer is running out of time. he's fighting to save the last oyster cannery in california. for nearly 100 years oysters have been harvested in what is now point reyes national sea shore. and he bought johnson's oyster farm and named it drake's bay oyster company. now, the park service wants him out this is parks spokesman in 2007. >> in 1976 the point reyes wilderness act stated this area is in wilderness. and by 2012 or sooner the commercial operation in this national wilderness system would be removed. >> that wilderness act created

point reyes national sea shore. the park service is trying to use to it get him out. legislatures say they never intended to get rid of the oyster farm. >> there was no issue. no contention and trust me in marin county with people had a beef boy hear about it. >> former congressman john burton along with a former assemblyman, william bagly helped write the law in 1960s and 70s and all tell abc 7 news some environmentalists and park service have twisted their words. bagly was a friend of the former owner. >> knowing charlie johnson i wasn't about to put the man out of business he wrote the legislation that would give property rights to the national park service saying because of the his storeal importance, it was always meant to be a part of the park. as proof he points to a 1961 feesibility study stating

existing oyster beds and cannery should continue under national sea shore status because of their public value. and the three wrote this letter to the secretary of the interior urging him to renew the lease. >> we think it's clear there is no intent on a congressional record or plain language of the law that the oyster farm continue. that it is supposed to go away in 2012. >> amy trainer with s.with environmental action committee questioning lawmaker's memories. >> i think authors of the legislation are entitled to their opinion. >> amy myer was part of the commission urging national park status for point reyes admits there was never specific discussion at the time. but says it was implied with the oyster farm would be shut down. >> and there was never a question but the intent of the ledge swlaigsz that this was a right of use in occupancy going to be terminated in

2012. >> myers says it was identified potential wilderness meaning if the oyster farm closed would it be returned to nature. >> we waited four decades for this become a reality f anything happens except termination of the lease that is a betrayal. >> supporters are citing state fishing rights. californians have a constitutional right to fish. and bagly says his legislation emphasized that. >> all statutes and regulations pertaining to shell fish cult vacation i'm going to repeat that. shell fish cult vacation including planting rights land rental remain in effect. >> opponents say the state has come down on their side therefore there is no say in the future of the oyster farm providing these letters from california department of fish and game as proof the oyster farm has to go. >> the state says primary jurisdiction and management is

with the national park service. >> they interpret letters to say fish and game department rejected rights to manage all operations in the estero. the owner of the oyster company says that makes no sense. >> the state of california retain the rights to continue shell fishing as demonstrated by the leases that have been paid to the state of california for the past 40 years since the sea shore was established. >> so we checked with the director of the state department of fish and game. he says that the state wants to keep the oyster operation it brings in tax money keeps a food source local and is good for the environment. >> we don't see a reason from the state's interest point of view for it to have to to go. >> he says the environmental groups are interpreting qlerts incorrectly. the state has jurisdiction and the qlerts were in response to a request by national park service to clarify what happens after 2012. and only if the farms lease

more california students are passing the exit ochl yam than ever before. for the first time all groups under the 90% range. and why the numbers are up in spite of cuts. >> nearly 95 prgs of students from class of 2011 passed the california exit exam. schools like burton high school had a strategy in place to make sure more of their students pass the test. >> burton we've been able to refigure master schedule so

best and brightest teachers work with the most vulnerable kids. >> students must pass english and math portions in order to get a diploma. students can start taking the exam in 10th grade and there are several chances to pass. those making steady increases were african americans and latinos. among african americans 83% of the class of 2006 passed the exam. compare that with today, more than 90%. among hispanics 85% of the class of 2006 passed the test compare that with today's numbers. more than 92%. 98% of the graduating white students passed but there is still an achievement gap between them but it's getting smaller. the principal says more school districts are assessing students to identify weaknesses. >> when a teacher has

reflecting on an area and kids didn't do well the teacher may need to reteach that content. >> and many schools have seen an improvement. >> i think we're seeing teachers and professionals in school sites that are just doubling down on their work doing, i mean talk about super heroes. they're doing more and more work with less resources. >> schools are also getting savvier. burton created a partnership with city college. the college offers classes in math and english at the high school which allows students to thrive academically earning college credit n san francisco, abc 7 news. >> to look at results from your local school just look for a link under see it on tv oo. and tonight's money matters stock prices climbed for a third day. the dow rose 143 points up almost 4% for the week. the nasdaq added 21.
